These Terms & Conditions ("Terms") govern your access to and use of the Fyello service ("Service") provided by Fyello Productivity SIA, registration number 40203455420, legal address Slokas street 30A - 15, Riga, Latvia ("Company"). By using Fyello, you agree to be bound by these Terms. Please read them carefully before accessing or using the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Service.

These Terms form a legally binding agreement between you and Fyello Productivity SIA. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Fyello is a peer-to-peer messaging service that allows users to communicate with each other via text, images, videos, files and other multimedia content.

3. User Eligibility

You must be at least 18 years old to use Fyello. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Conduct

1. You agree to use Fyello only for lawful purposes and in accordance with these Terms.
2. You are solely responsible for all content that you post, upload, transmit, or otherwise make available through Fyello.
3. To access and use our Service, you must register with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and may not share your login details or allow others to use your account. You are solely responsible for all activities conducted through your account.
4. You agree not to use Fyello to:
   1. Post, transmit, or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
   2. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
   3. Transmit spam, chain letters, or unsolicited communications.
   4. Use the Service for illegal or fraudulent activity.
   5. Interfere with or disrupt the operation of the Service or any servers or networks connected to the Service or Company.
   6. Collect or store personal data about other users without their express consent.

In case you encounter content that violates or may violate these Terms, please flag this content by contacting the Company at legal@fyello.com or report this content via the app. Our team will react to objectionable or harmful content reports within 24 hours and remove the content and block the user who provided the offending content.
7. To block a specific user from contacting you, please contact the Company at legal@fyello.com. Our team will react to user blocking requests within 24 hours and block the user from further contacting you.

5. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and disclose information about you. By using Fyello, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

6. Rights

To provide and operate the Fyello Service, you grant the Company a worldwide, non-exclusive, royalty-free license (with the right to sublicense and transfer) to use, store, reproduce, adapt, distribute, display, and transmit the content and information you submit through the Service. This license is solely for the purpose of delivering, operating, and improving the Service—for example, to deliver your messages, store them for later access, or display your profile to other users.

All intellectual property rights in Fyello, including but not limited to copyrights, trademarks, and trade secrets, are owned by the Company. You may not use, reproduce, modify, or distribute any content from Fyello without the Company's prior written consent.

We reserve all rights not expressly granted to you under these Terms. We may modify or discontinue any part of the Service at any time, with or without notice.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.

We welcome and value any feedback you provide regarding our Service. By submitting feedback, you agree that we may use it to operate, improve, or enhance our Service without any obligation to compensate you.

7. Termination

The Company may terminate or suspend your access to Fyello at any time, with or without cause, and without prior notice or liability. Upon termination, your right to use Fyello will immediately cease.

We may suspend or terminate your account if you violate these Terms or engage in behavior we believe may harm the Service, other users, or the Company.

Upon termination, we may delete your account and any associated data, unless we are required to retain it for legal or operational purposes.

8. Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with these Terms or your use of the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Latvia.

10. Changes to Terms

The Company reserves the right to modify or update these Terms at any time, without prior notice. It is your responsibility to review these Terms periodically for changes. Your continued use of Fyello following the posting of any changes constitutes acceptance of those changes.
