These Terms & Conditions ("Terms") govern your access to and use of the Birdy Chat service ("Service") provided by SIA Birdy McBirdface, registration number 40203455420, legal address Slokas street 30A - 15, Riga, Latvia ("Company"). By using Birdy Chat, you agree to be bound by these Terms. Please read them carefully before accessing or using the Service.

1. Acceptance of Terms

By accessing or using Bird Chat, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Service.

2. Description of Service

Birdy Chat is a peer-to-peer messaging service that allows users to communicate with each other via text, images, videos, files and other multimedia content.

3. User Eligibility

You must be at least 18 years old to use Birdy Chat. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Conduct

1. You agree to use Birdy Chat only for lawful purposes and in accordance with these Terms.
2. You are solely responsible for all content that you post, upload, transmit, or otherwise make available through Birdy Chat.
3. You agree not to use Birdy Chat to:
   1. Post, transmit, or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
   2. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
   3. Interfere with or disrupt the operation of the Service or any servers or networks connected to the Service or Company.
4. Collect or store personal data about other users without their express consent.
5. In case you encounter content that violates or may violate these Terms, please flag this content by contacting the Company at legal@birdy.chat. Our team will react to objectionable or harmful content reports within 24 hours and remove the content and eject the user who provided the offending content.
6. To block a specific user from contacting you, please contact the Company at legal@birdy.chat. Our team will react to user blocking requests within 24 hours and block the user from further contacting you.

5. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and disclose information about you. By using Birdy Chat, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

6. Intellectual Property

All intellectual property rights in Birdy Chat, including but not limited to copyrights, trademarks, and trade secrets, are owned by the Company. You may not use, reproduce, modify, or distribute any content from Birdy Chat without the Company's prior written consent.

7. Termination

The Company may terminate or suspend your access to Birdy Chat at any time, with or without cause, and without prior notice or liability. Upon termination, your right to use Birdy Chat will immediately cease.

8. Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with these Terms or your use of the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Latvia.

10. Changes to Terms

The Company reserves the right to modify or update these Terms at any time, without prior notice. It is your responsibility to review these Terms periodically for changes. Your continued use of Birdy Chat following the posting of any changes constitutes acceptance of those changes.
