This Privacy Policy describes how Fyello Productivity SIA, registration number 40203455420, legal address Slokas street 30A - 15, Riga, Latvia ("Company," "we," "us," or "our") collects, uses, and discloses information about you when you use the Fyello service ("Service"). By using Fyello, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you via email or through the Service. Your continued use of Fyello after the effective date constitutes your acceptance of the revised policy.

1. Information We Collect

  1. Information you provide:
    1. When you register for an account, we collect information such as your name, email address, and password. You may also provide additional information, such as a profile picture or other details, when using Fyello.
    2. When you start a new chat session with another user on the Fyello network, we collect the contact information of the contacts you are trying to reach to connect you with them. If a user you are trying to contact is not a user of Fyello, we send them an email with an invitation to join Fyello on your behalf. Your contacts can opt out of receiving further communication from Fyello.
    3. When you sign up for a waitlist, we collect information such as your name, email address and other information you provide by answering the optional questions.
    4. When you communicate with us, such as via email or our pages on social media sites, we may collect information like your name, contact information, and the contents of the messages you send.
  2. Messages and Content: We collect the content of messages and other materials that you send through Fyello, as well as information about the recipients of your messages.
  3. Usage Information: We collect information about your use of Fyello, including the type of device you use, your IP address, operating system, and other usage statistics.
  4. Information provided by other users: We collect information about you that we receive from other users when they attempt to start a new chat with you or when they report a chat with you (e.g. for potential breach of our policy). If another user adds you as a contact or attempts to initiate a conversation with you, we may receive your name and email address or phone number from them in order to deliver an invitation or show their contact list. This is only used to enable potential communication and is subject to your preferences and privacy rights.

Providing your personal information is generally voluntary. However, if you choose not to provide certain information (such as your email address or password), we may not be able to create or maintain your Fyello account or deliver key features of the service.

2. Use of Information

We may process the information we collect for the following purposes:

  1. To provide and maintain Fyello;
  2. To enable user-to-user communications;
  3. To personalize your experience and improve Fyello's functionality;
  4. To communicate with you, including sending you service-related announcements, notifications and updates;
  5. To enforce our Terms of Service and other policies;
  6. To protect the rights, property, or safety of the Company, our users, or others;
  7. For any other purpose with your consent.

We are the 'data controller' under European data protection laws of the personal information described in this Privacy Policy, since we determine the means and/or purposes of the data processing we perform.

We rely on the following legal bases under the General Data Protection Regulation (GDPR) to process your personal information:

  • Performance of a contract (Article 6(1)(b)) – to provide and operate the Fyello service, including enabling communications and managing your user account.
  • Legitimate interests (Article 6(1)(f)) – to operate, protect, and improve Fyello, including preventing abuse, maintaining network security, and enhancing user experience, where these interests are not overridden by your rights and freedoms.
  • Compliance with legal obligations (Article 6(1)(c)) – when required to meet legal obligations, such as responding to lawful requests from public authorities.
  • Your consent (Article 6(1)(a)) – where applicable, such as when inviting contacts to join Fyello or sending you marketing communications. You can withdraw your consent at any time by contacting us.

We do not use your personal data to make decisions based solely on automated processing that have legal or similarly significant effects on you.

3. Disclosure of Information

We may disclose your information to third parties in the following circumstances:

  1. With your consent or at your direction (e.g. with other users of Fyello when you communicate with them or join group conversations or channels);
  2. To comply with legal obligations or respond to lawful requests from governmental authorities;
  3. To protect the rights, property, or safety of the Company, our users, or others;
  4. In connection with a merger, acquisition, or other corporate transaction.

We engage third-party service providers to support our operations (e.g., cloud hosting, authentication, analytics, email delivery, customer support). We ensure all processors are bound by contractual obligations under Article 28 of the GDPR and only process your data on our instructions.

Some of our service providers are located outside the EEA, including in countries that may not provide the same level of data protection. Where such transfers occur, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses (SCCs).

4. Data Security

We implement commercially reasonable technical and organizational measures to safeguard your personal information against unauthorized access, disclosure, alteration, or destruction.

Please note, however, that no method of transmitting or storing data over the Internet is completely secure. We encourage you to use caution when deciding what information to share through the Service. While we strive to protect your information, we cannot guarantee the security of data transmitted through Fyello or stored on our systems.

Additionally, we are not responsible for any circumvention of privacy settings or security measures implemented on the Service or on third-party platforms you may access through Fyello.

5. Data Retention

We retain your information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. Your Rights

You have control over your personal information and how it is used. Within Fyello, you can update or delete your account information at any time by accessing your account settings. You may also opt out of receiving non-essential communications from us by following the unsubscribe instructions in those messages.

If you are located in the European Economic Area (EEA), the United Kingdom (UK), or other regions with similar data protection laws, you may have the following rights under applicable laws:

  • Access – You can request a copy of the personal data we hold about you.
  • Rectification – You can ask us to correct inaccurate or incomplete information.
  • Erasure (“Right to be Forgotten”) – You can request the deletion of your personal data in certain circumstances.
  • Restriction – You can ask us to limit the processing of your personal data.
  • Objection – You may object to our processing of your personal data when it is based on our legitimate interests.
  • Data Portability – Where applicable, you can request a copy of your data in a structured, commonly used, machine-readable format and request that we transfer it to another controller.

If we rely on your consent to process your personal data, you may withdraw that consent at any time by contacting us. Withdrawing consent does not affect the lawfulness of any processing carried out before the withdrawal.

If you believe we are unlawfully processing your personal data, you have the right to lodge a complaint with your local data protection authority.

To close your account, you may do so at any time through your account settings. Upon your request, we will deactivate or delete your account and remove your information from our active systems. Please note that we may retain certain data as required by law or for legitimate business purposes, such as fraud prevention, dispute resolution, and compliance with legal obligations.

7. Children's Privacy

Fyello is not intended for use by children under the age of 18. We do not knowingly collect personal information from children under 18.

By using the Service, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

If you believe that we have inadvertently collected information from a child under 18, please contact us immediately.
